Section I — Terms Applicable to Content Creators
These provisions govern the contractual relationship between CAST COIN PAGAMENTOS LTDA and the individual or legal entity registered as a CONTENT CREATOR who uses the systems for monetization and receiving payouts.
1. Scope of Service
Cast Coin provides technological infrastructure to facilitate spontaneous financial support (tips/donations) and the sale of digital products and author content between content creators and their respective audience and customers.
2. Eligibility and Registration
Registration is reserved for fully capable individuals 18 (eighteen) years of age or older. Minors may only access the platform with direct supervision and prior consent from their legal guardians. Using the platform for unlawful, fraudulent activities, sale of prohibited items, or actions contrary to public order is strictly prohibited.
3. Data Accuracy and Registration Verification
The Creator warrants the truthfulness and accuracy of provided details and undertakes to keep them updated. Cast Coin reserves the right to request identification documents and banking details for compliance checks, fraud prevention, and internal audits.
4. Transactions, Intermediation Fees, and Withdrawals
Financial transactions processed through PIX or credit card are subject to the applicable intermediation fee in effect at the time of operation. The net balance will be credited to the Creator's virtual wallet and will be available for withdrawal in accordance with standard bank clearance periods and system security policies.
4.1. Reversals, Payment Disputes, and MED
The Creator acknowledges and agrees that amounts reversed due to credit card purchase chargebacks, or arising from the Central Bank's Special Return Mechanism (MED) for the PIX arrangement, will be fully debited from available balances or withheld from future earnings.
5. Intellectual Property
All technological elements, source code, trademarks, logos, and layouts belong exclusively to Cast Coin Pagamentos Ltda. Access to the services grants solely a temporary, limited, and revocable license to use, without any assignment of intellectual property rights.
6. Limitation of Liability
Cast Coin does not warrant uninterrupted availability of the service and is not liable for technical instability arising from telecommunications carriers, downtimes in the Brazilian Payment System, third-party financial institutions, or force majeure events.
7. Account Closure and Termination
The Creator may request contract termination and account closure at any time, provided there are no pending financial liabilities. Cast Coin may suspend or close the account on reasoned grounds in case of breach of these rules or suspicion of fraud.
8. Jurisdiction
The courts of the Capital of the State of São Paulo/SP, Brazil, are elected to resolve any disputes arising from this contract, to the exclusion of any other jurisdiction.
Section II — Terms Applicable to Users (Supporters and Buyers)
These provisions govern the relationship between CAST COIN PAGAMENTOS LTDA and USERS who send voluntary donations or purchase digital products offered by content creators on the platform.
1. Scope
The platform acts as a technological intermediary enabling interaction and voluntary financial support to content creators, as well as facilitating the purchase of author digital contents sold by them.
2. Access Conditions and Capacity
The service is intended for persons 18 (eighteen) years of age or older, or properly assisted and authorized minors. The user expressly declares the lawful origin of funds used in transactions.
3. Payments and Refund Policy
Payments are processed through approved electronic arrangements (PIX and credit card networks). The user acknowledges that voluntary donations and tips sent during live broadcasts are voluntary and irrevocable, not eligible for return once message/alert is displayed on screen. For digital infoproduct purchases, the statutory 7 (seven) day right of withdrawal applies under Art. 49 of the Brazilian Consumer Defense Code (Law no. 8,078/1990), exercisable within 7 days from payment confirmation.
4. Content and Offer Responsibility
Cast Coin acts strictly as a technological intermediary and payment processor. Creation, accuracy, legality of materials offered, and any promises of physical or external deliverables are the sole and exclusive responsibility of the corresponding content creator.
5. Prohibitions and Misuse
Users are strictly prohibited from decompiling, reverse engineering, violating authentication mechanisms, or overloading Cast Coin's technical infrastructure, subject to civil and criminal penalties.
6. Governing Law and Jurisdiction
The laws of the Federative Republic of Brazil apply, electing the courts of São Paulo/SP for the resolution of any disputes arising from these Terms of Use.
